Terms of Service
These Terms of Service ("Terms") govern your use of the Trail Time mobile application and website (together, the "Service"), operated by Schley Adventures, LLC ("Trail Time," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What These Terms Cover
These Terms cover your account and your use of the Service — booking, payment handling, and the software itself.
They do not set the terms of an individual rental. Each rental is governed by the Rental Agreement & Safety Waiver you sign in the app before taking a vehicle, which covers safety rules, assumption of risk, liability, and your financial responsibility for damage. That signed agreement controls the rental itself. Where these Terms and a signed rental agreement conflict on a matter concerning the rental, the signed rental agreement governs.
2. Eligibility
- You must be at least 18 years old to create an account.
- You must complete identity verification, including a government-issued photo ID, before you can rent. Verification is performed by our identity provider; see our Privacy Policy for how that information is handled.
- Individual locations or vehicles may impose a higher minimum age or require a valid driver's license. Those requirements are shown at booking and in the rental agreement.
- You may hold only one account, and you may not create an account on someone else's behalf.
3. Your Account
- You are responsible for the accuracy of the information you provide.
- You are responsible for keeping your credentials confidential and for activity that occurs under your account. Tell us promptly if you believe it has been used without your permission.
- You may delete your account at any time from Profile → Delete Account. Deletion is not available while a rental or reservation is in progress. Some records are retained after deletion where we are required to keep them; the Privacy Policy describes what and for how long.
4. Reservations, Check-In, and Cancellation
- A reservation is a request until it is confirmed. We may decline or cancel a reservation, including where a vehicle becomes unavailable, verification cannot be completed, or we reasonably believe these Terms have been breached.
- Arrive within the window shown for your reservation. Reservations not claimed within that window may be released.
- Cancellation and no-show terms, including any fee, are shown before you confirm and in your confirmation.
5. Payments, Authorizations, and Deposits
Payments are processed by our payment provider. We do not receive or store your full card number.
- At checkout we place an authorization on your card for the rental amount and a separate authorization for the security deposit. An authorization is a hold, not a charge.
- The rental amount is captured when the rental completes. The deposit hold is released, or captured in part, according to the signed rental agreement.
- Rentals longer than seven days may require the authorization to be renewed during the rental period.
- How long a released hold takes to disappear from your statement is determined by your bank, not by us.
- Amounts owed for damage, late return, loss, or theft are governed by the signed rental agreement.
6. Photos You Submit
The Service asks you to photograph the vehicle at checkout and at return. These photos document vehicle condition and may be used to assess damage claims. You grant us permission to store and use them for that purpose and for our legal and insurance records. Do not submit photos containing people who have not agreed to appear in them.
7. Acceptable Use
You agree not to:
- Use the Service unlawfully, or to arrange a rental for someone who is not eligible;
- Provide false information, or impersonate another person;
- Interfere with the Service, attempt to access accounts or data that are not yours, or probe or test our systems without written permission;
- Submit content that is unlawful, or that you do not have the right to submit.
We may suspend or close an account that breaches these Terms, or where we reasonably suspect fraud or a risk to safety.
8. Availability
We work to keep the Service available, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend, or discontinue features. The Service requires an internet connection.
9. Our Role and Limits of Liability
This section limits our liability for the Service. It does not affect the assumption of risk and release you agree to in the signed Rental Agreement & Safety Waiver, which governs the rental and operation of a vehicle.
Except where the law does not permit it, the Service is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, and except for liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation — our total liability arising out of or relating to the Service is limited to the amount you paid us for the rental giving rise to the claim.
Nothing in these Terms waives any right you have under applicable consumer protection law.
10. Changes to These Terms
We may update these Terms. We will post the updated version here and change the effective date above. Material changes will be communicated through the Service or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of laws rules. Any dispute not resolved informally will be brought in the state or federal courts located in Mississippi, and you and we consent to their jurisdiction.
